D&M wins appeal for the retention of a communal TV aerial, mast and satellite dish in West Ewell February 2009
A Planning Inspector has allowed an appeal for the retention of a communal TV aerial, mast and satellite dish on a new residential development site in West Ewell. Epsom and Ewell Borough Council had refused permission on the basis that the communal aerial had an unacceptable effect on the character and appearance of the area and because of its effect on the living conditions of neighbours in terms of visual impact. The Authority subsequently issued an Enforcement Notice.
In determining the Section 78 appeal, the Planning Inspector considered the mast to be a relatively modest structure which is set well into the site. Although visible form Ruxley lane, its design, attachments and distance from the road are such that it does not have a harmful impact on the character and appearance of the area. The fact that the communal mast would save the proliferation of private aerials and satellite dishes on individual dwellings within the Mews adds to my view that the development would not be harmful
She went on to say that the mast is not a dominant or obtrusive feature and is not significantly harmful to the outlook of neighbouring properties. Following that successful decision the Local Planning Authority withdrew the outstanding Enforcement Notice.
